Appealing a Denied BOP Request (Background Check)

After your background check request (called a BOP Request) is reviewed, you may be denied access to one or more HCSO facilities. This means you would not be able to have an in-person visit or video visit at those facilities.

A denial does not block all contact. If you were denied because of past incarceration, probation, or parole within the last 12 months, you may still be able to have phone visits or video visits that do not require you to enter the facility.

 

Who can appeal?

You may appeal if the Resident you want to visit is your spouse or immediate family member.

 

How to Appeal

  1. Write a letter that includes:
    • Your full name and date of birth
    • The name of the Resident you want to visit
    • The facility where that Resident is currently housed
    • Your reason for requesting access
  2. Mail your letter to the facility where the Resident is currently housed

    • Designate the attention as “ATTN: BOP Appeals

If your appeal is approved, your Visit Restrictions in our Visitor Portal will be updated reflecting the change.

 

Keep in mind

  • Any appeals are only valid for the lifetime of the corresponding BOP Request. If your BOP Request expires, your appeal approval expires with it.
  • Access to the Resident named in your appeal is also restricted to the facility where they are housed at the time of approval. If that Resident is moved to another facility, you would need to send a new appeal to that new facility.
